Smart AI Campus Terms & Conditions
These Terms explain who provides Smart AI Campus, who may use it, and the rules for using it. Please read them together with our Privacy Policy.
1. Agreement
These Terms are a legally binding agreement between you and Vicky Bhavnagri (the “Owner”, “we”, “us”), and govern your use of the Smart AI Campus mobile apps, the web app and this website (the “Service”). By using the Service you accept these Terms. If you do not accept them, do not use the Service.
2. Who We Are
Smart AI Campus is maintained and operated by Vicky Bhavnagri, an individual based in Mumbai, India.
Address: P/13 Godrej Baug, Off Nepeansea Road, Mumbai 400026, Maharashtra, India.
Email: support@smartaicampus.app
3. The Service
Smart AI Campus is business software provided to schools and colleges (“institutes”). It records per-lecture student attendance using a rotating QR code, a classroom Bluetooth signal and a device lock, and adds student leave, personal timetables, holidays, reports and alerts.
You get access through your institute. Institutes are set up by the Smart AI Campus team; staff are added by email, and students and parents through the institute's spreadsheet import.
4. Eligibility
- You must be at least 13 to use the Service.
- If you are under 18, you may use the Service only through your institute, which is responsible for any parental consent the law requires.
5. Accounts and Security
- Keep your sign-in details private. You are responsible for what happens under your account.
- Your student account is tied to one phone (the device lock). Do not try to get around it.
- Tell us or your institute straight away if you think someone else has used your account.
6. Acceptable Use
You must not:
- mark, or try to mark, attendance for someone else, or get someone to mark it for you (proxy attendance);
- copy, forward, replay or tamper with the QR code, the classroom Bluetooth signal or the device lock;
- reverse engineer, decompile or modify the apps, except where the law allows it;
- access data you are not allowed to see, or interfere with the Service's security or operation;
- use the Service to harass anyone, or to break the law.
Your institute may also apply its own disciplinary rules to misuse.
7. Institute Responsibilities
Each institute that uses the Service is responsible for:
- having a lawful basis, and any consent the law requires (including parental consent for students under 18), for the data it imports or enters;
- keeping that data accurate and up to date;
- deciding who gets which role, and handling its students' and staff's requests about the institute's records.
8. No Fees in the Apps
The apps are free to download and contain no in-app purchases. Access is granted to institutes under a separate agreement with us. If an institute's access period ends, its data may become read-only.
9. Privacy
How we handle data is described in our Privacy Policy, which forms part of these Terms.
10. Intellectual Property
The Service, its software, design, name and logo belong to the Owner. We give you a personal, non-transferable, revocable licence to use the apps for their intended purpose while you have access through your institute. Your institute's data remains the institute's.
11. Deleting Your Account and Termination
- You can delete your account at any time in the app or on the web. See Delete your account for the steps and for what is kept.
- We or your institute may suspend or end your access if you break these Terms or misuse the Service.
- Your access also ends if your institute stops using the Service or removes you.
12. Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we make no warranties beyond those set out in these Terms, and we do not promise that the Service will always be uninterrupted or error-free. Attendance decisions, leave decisions and any consequences of them are the institute's.
13. Limitation of Liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for loss of data, profits or goodwill, arising from your use of, or inability to use, the Service. Nothing in these Terms limits liability that cannot be limited by law.
14. Governing Law
These Terms are governed by the laws of India. The courts in Mumbai, Maharashtra, have jurisdiction over any dispute about them.
15. Changes to These Terms
We may update these Terms. When we do, we change the effective date at the top. If a change is significant, we will tell users in the app or by email before it takes effect. Continuing to use the Service after that means you accept the new Terms.
16. Apple-Specific Terms
If you use the app on an Apple device, these additional terms apply:
- These Terms are between you and the Owner, not Apple Inc. (“Apple”). The Owner, not Apple, is solely responsible for the app and its content.
- Your licence to use the app is limited to Apple-branded devices that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide any maintenance or support for the app.
- If the app fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; the app is free, so normally there is none. Apple has no other warranty obligation for the app.
- The Owner, not Apple, is responsible for any claims about the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection or privacy claims.
- If anyone claims that the app or your use of it infringes their intellectual property, the Owner, not Apple, is responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them Apple may enforce them against you.
Apple's standard Licensed Application End User License Agreement is at apple.com/legal/internet-services/itunes/dev/stdeula.
